Privacy Policy

We at Crowdspending want our Internet site (the “Site”) to be a safe and private place for users. It is understood that Members (as defined in the Terms of Use) and users furnish sensitive information to Crowdspending and expect privacy and security. Crowdspending is committed to treating such information responsibly and only for your benefit.

The following Privacy Policy covers the “Personal Information” and other information provided through the Site. “Personal Information” is information that identifies you personally, either alone or in combination with other information available to us. Examples of Personal Information include your name, address, email address, or information you provide when you make any Crowdspending product purchase through the Site.

We cannot protect your privacy once you leave our Site, such as by "hyperlink." So when you visit other websites, check each one’s privacy policy yourself, and be careful about the information you submit or share. In addition, this Privacy Policy does not apply to the practices of third parties that Crowdspending does not own or control, or individuals that Crowdspending does not employ or manage.

You should be aware that in some areas of the Site we utilize personalization measures designed to make your site experience more enjoyable (e.g., personalized links in e-mail that allow data fields to be pre-populated with certain Personal Information). Thus, you should always keep your password, if applicable, e-mail account information and Member Account information secure and not allow others to access them. YOU ARE FULLY RESPONSIBLE FOR ALL ACTIVITY, LIABILITY AND DAMAGE RESULTING FROM YOUR OWN FAILURE TO MAINTAIN YOUR PERSONAL INFORMATION CONFIDENTIAL.

Any time Personal Information is provided, this Privacy Policy will govern our use of the information you have provided. This Privacy Policy is part of and subject to the Terms of Use that govern use of the Site.

I. Your Consent to This Privacy Policy

By accessing or using the Site, you are agreeing to the terms of this Privacy Policy. By submitting Personal Information, you agree that we may use the Personal Information in accordance with this Privacy Policy. II. Changes to This Privacy Policy.

Crowdspending may update this Privacy Policy from time to time, and our use of the Personal Information and other information we collect is subject to the terms of the Privacy Policy then in effect. The changes will be effective as of the date we post the revised version on the Site. In the event that changes are made, such changes will be posted on the Site, and use of the Site following any such change constitutes your consent to the terms of the revised Privacy Policy. Thus, it is important that you review our Privacy Policy regularly.

III. Personal Information You Choose to Provide.

If Personal Information is submitted, it will be used for the purposes for which it was submitted. We have no intention and will never use your personal information to sell to advertisers or marketers.

We also may provide opportunities for you to submit additional information, such as Site feedback. By submitting this information, you give us permission to receive it, review it, edit it, store it, post it on the Site, and use it in appropriate settings. To protect your privacy, please do not include any identifying Personal Information in these types of submissions.

From time to time, Crowdspending may supplement the Personal Information you give us with information from other sources, such as information validating your address or demographic information based on your zip code. We may also supplement the Personal Information you give us with information we collect through other channels.

IV. With Whom We Share Your Personal Information.

Except as provided in this Privacy Policy, Personal Information will not be disclosed, sold, or traded to third parties without your consent.

If Crowdspending wishes to disclose your Personal Information to a third party, except for in the situations provided in this section below, we will offer you the means to consent to this new use via an e-mail or written request prior to any such use.

A. Compliance with Laws and Protection of Crowdspending’s Rights and the Rights of Others.

Crowdspending may disclose Personal Information, without your consent, when we, in good faith, believe disclosure is appropriate to comply with the law, a court order or a subpoena. Crowdspending may also disclose Personal Information to prevent or investigate a possible crime, such as fraud or identity theft, to enforce or apply our Terms of Use or other agreements and policies, or to protect our own rights or property or the rights, property or safety of Members or others.

Crowdspending may also disclose Personal Information, without your consent, to parties in compliance with Crowdspending procedures as we in our sole discretion believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity.

B. Administrative Needs.

Crowdspending employs and works in conjunction with other companies and people to perform tasks on our behalf and may need to share your Personal Information with them (without your consent) to provide services to you. Examples include, but are not limited to, analyzing data, providing customer service such as maintaining our databases, sending e-mail messages to supporters, dealing with Member calls, managing Crowdspending, facilitating activities and campaigns.

V. Information Automatically Collected and Stored

As is true of most websites, we automatically collect and store some information about your computer or mobile device and your visit and store it in log files. This information includes information such as your computer’s (or your ISP’s) Internet Protocol (IP) address (this is not your e-mail address); the domain from which you access the Internet; the name, version, and specifications of your computer or mobile device and your computer’s or mobile device’s operating system; the Internet address of the website, if any, from which you came to our Site; the date and time you arrived at our Site and how long you spent on the Site; and which pages you visited.

We use this information to formulate statistics (possibly with the help of outside experts) that show the number of visitors to the different sections of our Site and to help us make our Site more useful to visitors. For example, we use the browser information to help us design our Site so that as many people as possible will be able to view the pages correctly. These statistics do not reveal Personal Information.

VI. Use of Cookies and Similar Technologies

Cookies are small text files that are either placed on your computer’s hard drive, tablet or other mobile device ("persistent cookies") or in your computer’s or mobile device’s Random Access Memory ("session cookies"). We use both persistent cookies and session cookies for various sections of our Site.

A. Session Cookies.

We use session cookies to make it easier for you to navigate certain sections of our Site. If you choose to provide Personal Information by using an interactive application on our Site, such as by joining our e-mail list, or registering with us as a Member, or making an online donation or asking a question, we place a session cookie on your computer or mobile device so that you will be recognized as you move around our Site pages. Unless you opt-in to change these session cookies to persistent cookies (see "Persistent Cookies" below), the information is only used for the duration of your browser session. As you move through the Site, any fields requiring information about you that has already been captured will be pre-populated. However, once you close your browser window, the session cookie times out. If you open a new browser window and return to our Site, your information fields will not be pre-populated.

B. Persistent Cookies.

We use persistent cookies in some sections of our Site to provide greater accuracy in our analysis of the information that is automatically collected about your visit to our Site. A persistent cookie remains on your hard drive or mobile device for an extended period of time. These cookies do not collect Personal Information. We do not link the information collected through these cookies with other personal data that you provide to us.

In certain circumstances, you may be given the option to turn a session cookie into a persistent cookie on your computer or mobile device (e.g., "Would you like us to remember your password?" messages). If you opt to turn a session cookie into a persistent cookie, that persistent cookie will remember your Personal Information (e.g., user name and password) and will not time out at the end of your browser session. C. Disabling Cookies.

Persistent cookies leave a record on your computer or mobile device that you have visited our Site. However, you have the ability to remove cookies from your computer or mobile device. Your Internet browser’s "Help" section will give you information on how to delete cookies. In addition, there are many websites that provide browser- and operating system-specific information on how to delete cookies. When thinking about whether you want to delete cookies, you should be aware that some sites require cookies to function properly. If you delete cookies, you may have to re-register with some sites or you may notice difficulty in browsing some sites after you delete cookies.

D. Clear Gifs (Web Beacons).

We may employ a software technology called clear gifs (a.k.a. Web Beacons) that help us better manage content on our Site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not link the information gathered through clear gifs with other Personal Information that you provide to us.

VII. Service-Related Announcements and Promotional Messages

A. Service-Related Announcements.

Crowdspending may send you a welcome/confirmation email when you create a Member Account. Crowdspending may also send you additional notices as detailed in the Terms and Conditions. Receipt of these emails and notices is required for using Crowdspending’s services as a Member.

We will send Members service-related announcements on rare occasions when it is necessary to do so. You may not opt-out of service-related communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your Member Account by emailing (from the email address you signed up with) Crowdspending at the email address listed below.

B. Promotional Messages.

Crowdspending may periodically email you with promotional messages. We will not sell or rent your Personal Information to third parties for their marketing purposes without your explicit consent. Your Personal Information may be combined with information Crowdspending collects from other companies and used to improve and personalize services, content and advertising. If you do not wish to receive promotional messages or participate in these programs, simply opt-out by emailing Crowdspending at the email address listed below.

Please note that if you do not wish to receive promotional messages from us, those notices will still govern your use of the Site and Crowdspending’s services, and you are responsible for reviewing such notices for changes.

VIII. Information Sharing and Disclosure

Personal Information that you post publicly on the Site is accessible to the public; you may receive unsolicited messages from other parties in return. Crowdspending is not responsible for the Personal Information you choose to post publicly on the Site.

IX. Third Parties

Except as otherwise expressly included in this Privacy Policy, this policy addresses only the use and disclosure of Personal Information that Crowdspending collects from you. If you disclose your Personal Information to others, including other Members, different rules may apply to their use or disclosure of the Personal Information you disclose to them. Crowdspending does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. Crowdspending is not responsible for the privacy or security practices of other websites on the Internet, even those that may be linked to or from the Site. We encourage you to ask questions before you disclose your Personal Information to others.

X. Security

Information submitted via the Internet, including through a web page or e-mail, is subject to interception or incorrect routing, and the Internet is not a fully secure communications channel. Please consider this prior to submitting any information to us via this Site.

Crowdspending uses industry-standard security measures on the Site. While we follow generally accepted industry standards to protect the Personal Information submitted to us, no method of transmission over the Internet, or method of electronic storage, is 100 percent secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

When you register with or become a Member through the Site, you will have a Member Account, where you will be able to edit your Personal Information, as well as review your activity. Access to your Member Account is controlled to protect the privacy of your data.

XI. Your Options

A. Rights to Access, Correct and Eliminate Personal Information.

You have a right to access, modify, correct and eliminate the data you supplied to Crowdspending. If you update any of your Personal Information, we may keep a copy of your Personal Information that you originally provided to us in our archives for uses documented in this Privacy Policy. You may request deletion of your Personal Information at any time by contacting Crowdspending as provided below. Please note, however, that Personal Information you have shared with others, or that other Members or users have copied due to your sharing, may also remain visible even if you request its deletion

B. Closing Your Member Account.

You can close your Member Account by providing Crowdspending written notice pursuant to the terms of the Terms of Use. If you close your Member Account, we will remove your name and other Personal Information from our publicly viewable database. If you close your Member Account, we have no obligation to retain your Personal Information, and may delete any or all of your account information and Personal Information without liability. However, we may retain certain data contributed by you if we believe it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally identifiable data, account recovery, or if required by law.

XII. Children

The Site is not directed nor targeted to children under the age of eighteen (18). We do not use the Site to knowingly solicit data from or market to children under the age of eighteen (18). If you are under the age of eighteen (18), do not provide us with any Personal Information. If we learn that someone under eighteen (18) (and especially under the age of thirteen (13), as provided in the Children’s Online Privacy Protection Act of 1998) has provided Personal Information to the Site, we will use best efforts to remove such Personal Information from our databases.
